Inspection requirement for construction machinery: the legal basis

Excavators, wheel loaders, tracked vehicles and dumpers are found on almost every site - and they are all subject to the periodic inspection of work equipment under the Working Conditions Decree. The inspection of construction machinery is not an optional service but a binding requirement of Dutch occupational health and safety legislation (Working Conditions Act and Working Conditions Decree). Anyone who misses inspections or neglects the documentation faces considerable liability risks - including for damage to third parties.

This guide explains the duties of construction companies and fleet managers and provides an overview of inspection intervals, scope of inspection and documentation requirements.

The inspection requirement for construction machinery follows from the Working Conditions Decree, Chapter 7 (work equipment), in conjunction with the Working Conditions Act (Arbowet). Basis:

  • Working Conditions Decree, Chapter 7 (work equipment): employers must keep work equipment in good condition and have it inspected periodically for safe use
  • Working Conditions Act (Arbowet): the employer ensures safe working conditions and the required competence of the inspector
  • NEN-EN standards and manufacturer requirements supplement the statutory minimum requirements

Which machines are covered?

The inspection requirement applies to all self-propelled and non-self-propelled construction machinery used commercially - regardless of year of manufacture, engine power or frequency of use:

  • Excavators (crawler excavators, wheeled excavators)
  • Wheel loaders and compact loaders
  • Rollers (soil, asphalt, combination rollers)
  • Tracked vehicles and dozers
  • Dumpers and dump trucks
  • Mobile excavators and hydraulic excavators
  • Compaction equipment (plate compactors, rammers - depending on classification)

Not every machine is subject to exactly the same requirements - for special machines and borderline classifications, consult your safety expert or the Netherlands Labour Authority (Nederlandse Arbeidsinspectie).

Inspection intervals for construction machinery

Inspection intervals follow from applicable Dutch health and safety rules, the risk assessment and the manufacturer's requirements. Shorter intervals are needed if:

  • the risk assessment identifies particular risks
  • the manufacturer recommends shorter intervals
  • the machine is used intensively (shift work, harsh environments)
  • an additional inspection is needed after a defect or accident

Scope and procedure of the inspection

Visual inspection

External check of the entire piece of work equipment without the machine running: frame for cracks and deformation, access guards, protective devices, markings and inspection stickers, visible leaks, condition of tyres or tracks.

Function test

Check of all safety-relevant functions in operation: braking and steering system, lifting equipment, quick couplers (attachments), warning signals, lighting, safety interlocks, cab and seat belt, overload protection on hoists.

Documentation

All findings, defects and measures are recorded in writing in the inspection report. The report contains at least the following details: machine identification, inspection date and inspector, items checked as a checklist, description of defects and measures, sticker number and date of the next inspection. Keep the record at least until the next inspection; in practice, a documentation folder that stays with the machine is recommended.

Who may inspect construction machinery?

The periodic inspection must be carried out by a competent inspector in line with applicable Dutch health and safety rules. In practice, this requires:

  • Relevant vocational training (e.g. mechatronics technician, agricultural and construction machinery mechanic)
  • Work experience with the class of machine to be inspected
  • Recent professional experience with these machines

Cost guide by machine class

Inspection costs for construction machinery vary greatly by machine class, scope of inspection and inspector. Indicative ranges from the market:

  • Compact construction machinery (mini excavators, plate compactors): approx. €80-150 per inspection
  • Wheel loaders, medium-sized excavators (up to 20 t): approx. €150-280 per inspection
  • Heavy construction machinery (>20 t, large excavators, roller trains): approx. €250-500 per inspection
  • Special machines (milling machines, tunnel boring machines): on request

Frequently asked questions

Is periodic inspection of construction machinery mandatory?

Yes. The Working Conditions Decree, Chapter 7 (work equipment), calls for periodic inspection of work equipment used commercially - construction machinery is included. Violations can lead to enforcement by the Netherlands Labour Authority (Nederlandse Arbeidsinspectie) and, in the event of damage, to liability.

How often do excavators and wheel loaders have to be inspected?

This follows from applicable Dutch health and safety rules, the manufacturer's requirements and the employer's risk assessment. With particularly intensive use or increased hazards, shorter inspection intervals may be needed. The employer's risk assessment is decisive.

Who may carry out the periodic inspection of construction machinery?

Is rented construction machinery already inspected?
